I've been doing a little reading about this case lately. Richard Tuite, the man who was convicted in Stephanie's killing, had his conviction overturned by the 9th Circuit Court recently. I think he's guilty, mainly because of the blood evidence. Anyone think Michael and his friends did it?

I think this is one where we'll never know for sure. What grounds did the 9th Circuit use to reverse Tuite's conviction. Also, keep in mind that SCOTUS frequently reverses the 9th Circuit, so Tuite's not home free, yet.

The only issue in the appeal was a 6th Amendment confrontation clause error. Opinion is here: www.ca9.uscourts.gov/datastore/memoranda/2011/09/08/09-56267.pdfIf the ruling survives both 9th Circuit en banc and SCOTUS, I think it could very well end with an Alford plea. Considering that voluntary manslaughter is the only charge Tuite will face, and the fact that the first trial lasted 3 months with the second to probably last the same, and the difficulty of prosecuting the case, I think the state would be willing to accept an Alford plea to something less than the maximum term.
